Areaplane End User License Agreement & Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Areaplane for iOS (“the App”), developed and published by Lightplane Inc. (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. These Terms constitute a custom end user license agreement between you and Lightplane Inc. and apply in addition to Apple's App Store Terms and policies. If you do not agree, do not use the App.

2. Description of the App

Areaplane for iOS is a measurement and area calculation tool that allows you to upload floor plans, trace areas, and calculate approximate square footage on your iPhone and iPad. Projects are stored locally on your device and synced via your personal iCloud account.

3. Subscription Plans

The App offers both free and premium features. Premium features are unlocked through one of the following subscription options, purchased via Apple's In-App Purchase system:

a) Yearly Subscription

  • Billed annually at the price displayed at the time of purchase.
  • Automatically renews at the end of each billing period unless cancelled at least 24 hours before the renewal date.
  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

b) Lifetime Purchase

  • A one-time purchase that unlocks premium features indefinitely with no recurring charges.
  • “Lifetime” refers to the lifetime of the product, meaning for as long as Areaplane for iOS is available and maintained (see Section 8).
  • The lifetime purchase is tied to your Apple ID and available on all devices signed into that account.

4. Free Trial

We may offer a free trial period for the yearly subscription. If you do not cancel before the trial ends, your Apple ID will be charged for the first billing period. You can cancel the trial at any time through your Apple ID subscription settings.

5. Payment & Billing

  • All payments are processed by Apple through the App Store. We do not collect or store your payment information.
  • Prices are displayed in your local currency and may vary by region. Prices may change at any time, but changes will not affect active subscription periods.
  • You can manage or cancel your subscription at any time in Settings > [Your Name] > Subscriptions on your device.

6. Refunds

Refunds are handled by Apple in accordance with their refund policy. To request a refund, visit reportaproblem.apple.com. We are unable to process refunds directly.

7. Updates & New Features

We regularly update the App to fix bugs, improve performance, and add new features. Both yearly subscribers and lifetime purchasers receive all updates released during their access period.

We reserve the right to change which features are included in the free tier and which require a premium subscription. If a feature you currently use becomes premium-only, your existing data and measurements will remain accessible.

We may introduce new premium tiers or add-ons in the future. Existing lifetime purchasers will retain access to all features included at the time of their purchase.

8. Discontinuation of the App

While we intend to maintain and develop Areaplane for iOS for the foreseeable future, we reserve the right to discontinue the App at any time.

If the App is discontinued:

  • Active yearly subscribers will not be charged for any future billing periods. Your subscription will remain active until the end of your current paid period.
  • Lifetime purchases are non-refundable upon discontinuation. The “lifetime” designation refers to the lifetime of the product, not a guarantee of perpetual availability.
  • We will provide reasonable notice before discontinuation and ensure you can export your project data.
  • Already-downloaded versions of the App will continue to function on your device, though we cannot guarantee compatibility with future iOS versions.

9. Measurement Disclaimer

Estimates only. All measurements generated by the App are approximations based on user input (scaling, tracing accuracy, image quality) and may differ from actual dimensions.

Not a professional substitute. The App is not a replacement for licensed surveying, architectural measurement, engineering analysis, or any other professional assessment. Do not rely solely on measurements from this App for legal, financial, real-estate, insurance, or construction decisions.

10. Privacy & Data

Your project data is stored locally on your device and synced via iCloud. We do not collect, transmit, or store your floor plans, images, or measurements on our servers. For full details, see our iOS Privacy Policy.

11. Intellectual Property

All content, code, design, and branding of Areaplane are the property of Lightplane Inc. You may not copy, modify, distribute, reverse-engineer, or create derivative works of the App without prior written permission.

12. Limitation of Liability

To the fullest extent permitted by law, Lightplane Inc. and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the App, including damages resulting from inaccurate measurements, loss of data, or inability to access premium features.

13. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or compatible with all devices or iOS versions.

14. Changes to These Terms

We may revise these Terms from time to time. The updated version will be indicated by the “Last updated” date at the top of this page. Continued use of the App after changes constitutes acceptance of the revised Terms. For material changes that affect your subscription, we will notify you through the App or via the App Store.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to conflict of law principles.

17. Apple App Store Terms

Lightplane Inc., not Apple Inc., is responsible for the App and its content. These Terms apply between you and Lightplane Inc., not Apple.

If you downloaded the App from the Apple App Store, your use of the App must also comply with Apple's App Store Terms of Service and the Apple Licensed Application End User License Agreement.

To the extent that these Terms conflict with Apple's Licensed Application End User License Agreement, these Terms will apply solely between you and Lightplane Inc.

You acknowledge and agree that:

  • (a) Apple has no obligation to provide maintenance or support services for the App.
  • (b) Apple is not responsible for addressing any claims relating to the App, including but not limited to product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, or claims arising under consumer protection, privacy, or similar legislation.
  • (c) In the event of any third-party claim that the App infringes intellectual property rights, Lightplane Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
  • (d) Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • (e) You represent and warrant that you are not located in a country subject to a U.S. government embargo or listed on any U.S. government list of prohibited or restricted parties.

18. Maintenance and Support

Lightplane Inc. is solely responsible for providing any maintenance or support services for the App. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.

19. Third-Party Services

The App may rely on or integrate with services provided by Apple or other third parties, including but not limited to iCloud synchronization services.

Your use of such third-party services may be subject to additional terms and conditions imposed by those providers. Lightplane Inc. is not responsible for the availability, performance, or accuracy of third-party services.

If such services become unavailable, certain features of the App may not function as intended.

20. Eligibility

You must be at least 13 years of age, or the minimum age required in your jurisdiction to use the App, to download or use Areaplane for iOS.

If you are under the age of majority in your jurisdiction, you must use the App under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.

21. Apple ID and Subscription Responsibility

Purchases and subscriptions are associated with your Apple ID account. You are responsible for maintaining access to your Apple ID and for managing your subscriptions through Apple's App Store settings.

Lightplane Inc. cannot access, modify, cancel, or refund subscriptions on your behalf. All billing, subscription management, and refund requests are handled by Apple through the App Store.
